Terms of engagement

A survey is professional work done on a particular boat on a particular day. These terms set out what that means in practice. The engagement letter for each job adds the boat, the place, the fee and the scope, and if the two ever differ, the letter wins.

Who you are dealing with

Surveys are carried out by EuroNautica Perizie & Brokerage Marittimo S.r.l., Riva Nazario Sauro 12, 34124 Trieste, Italy. Every survey is attended and signed by Capt. Matteo Ferraro. The engagement is a contract for intellectual professional work (contratto d’opera intellettuale) under Articles 2229 and following of the Italian Civil Code.

What a survey is

The report records the condition of the vessel as we found it, at the date and place of inspection, in the parts we could reach without dismantling anything. It is our professional opinion. It is not a warranty that the vessel is free of defects, a guarantee of future performance or a certificate of seaworthiness for any voyage.

  • We do not open sealed or glassed-in areas, remove fixed linings or lift engines unless the owner agrees in writing and the yard does the work.
  • Ultrasonic and moisture readings are taken at the stations shown in the sounding schedule. Areas between stations are inferred, not measured.
  • Rigging is inspected from deck level unless a mast inspection is in the scope.
  • Oil analysis results are a trend indicator from one sample. They do not replace a full engine survey by the manufacturer’s agent.

Your part

The client arranges, and pays the yard directly for, the haul-out, pressure wash, blocking, any staging, and the fuel and skipper for the sea trial. The client also obtains the owner’s permission for the survey and for any test holes or core samples. We will not drill a hull without written consent from its owner.

During the sea trial the vessel stays under the command of its owner’s skipper. Capt. Ferraro is aboard as surveyor, not as master, and will ask for the trial to stop if he thinks the boat or anyone on her is at risk.

Weather and rescheduling

Our coast has the Bora and the Jugo, and neither reads our diary. If wind, sea or a yard closure makes the haul-out or sea trial unsafe, we rebook at the first sensible date and do not charge for the lost day. Yard and travel costs already spent are passed on at cost. If you cancel less than 48 hours before a survey for any other reason, we charge half the fee to cover the day we held for you.

Fees and payment

Fees are quoted in euro, plus VAT where it applies. Half is due on acceptance of the engagement letter and the balance before the report is released. Travel outside Friuli Venezia Giulia is charged at cost and shown in the quote.

Liability

We carry professional indemnity insurance for our survey work. Our liability to the client for any claim arising from a survey is limited to the amount stated in the engagement letter. That limit does not apply to loss caused by our wilful misconduct or gross negligence, because Article 1229 of the Civil Code does not allow it to. Where the survey raises technical problems of special difficulty, Article 2236 of the Civil Code applies.

The report is written for the client named in it. A lender or insurer named in the engagement letter may rely on it for the purpose of the loan or the policy. Anyone else who reads it does so without any contract with us.

Consumers

If you are buying a yacht for private use and not as part of your trade, you are a consumer under the Italian Consumer Code (D.Lgs. 206/2005). Nothing in these terms takes away the rights that code gives you. Where an engagement is agreed entirely at a distance, you have fourteen days to withdraw, unless you ask us to carry out the survey sooner and the survey has then been completed.

The website and the calculator

The articles and tools on this site are general information. The hull speed, displacement-length, comfort ratio and passage fuel calculator uses standard formulas and the figures you enter. It is a planning aid for a conversation about a boat, not a passage plan. Real fuel burn depends on load, fouling, sea state and how the boat is driven. Always plan your own passage, check the forecast and carry more fuel than any formula tells you.

Text, drawings and diagrams on the site belong to EuroNautica Perizie & Brokerage Marittimo S.r.l.. You are welcome to quote a short passage with a credit. Please ask before reusing the drawings.

Law and courts

These terms and every engagement are governed by Italian law. Disputes go to the courts of Trieste, except that a consumer may always bring or face proceedings in the courts of the place where they live.

Terms revised October 2026.
