Privacy notice

Survey work means handling other people’s names, boats and money. This notice explains what we hold, why we hold it and when we let go of it. It is written for clients, sellers, brokers and anyone who reads this site.

Who holds your data

The data controller (titolare del trattamento) is EuroNautica Perizie & Brokerage Marittimo S.r.l., Riva Nazario Sauro 12, 34124 Trieste, Italy. Write to [email protected] about anything in this notice. We are a small firm and have not appointed a data protection officer, as the law does not require one for work of our size and kind. Capt. Matteo Ferraro answers privacy questions personally.

We apply the EU General Data Protection Regulation (Regulation (EU) 2016/679) and the Italian Codice in materia di protezione dei dati personali (D.Lgs. 196/2003, as amended by D.Lgs. 101/2018).

What goes into a survey file

Skipper and crew names on sea trialCrew of the vesselRecorded in the sea trial log for safetyLegitimate interest; legal duty of safe navigation

We do not ask for health data, and we do not want it. If someone on a sea trial tells us about a medical condition so we can plan for it, we use that only on the day and do not write it into the report.

Oil samples and laboratories

Engine oil and coolant samples go to an independent analysis laboratory. The sample bottle carries a job number, the engine type and its running hours. It does not carry your name or the seller’s. The laboratory sends the results to us, and we put them in your dossier.

Who else sees the report

The report belongs to the client who paid for it. We send it to them and to nobody else, unless they tell us in writing to share it with a lender, an insurer, a broker or a buyer. If a bank or underwriter has asked for the survey as a condition of a loan or a policy, the client usually names them in the engagement letter, and we send them a copy on that instruction.

We use an email provider and a cloud storage provider to run the office. Both act as data processors under written agreements. Where either stores data outside the European Economic Area, the transfer relies on an adequacy decision or on the European Commission’s standard contractual clauses.

We may have to hand over a survey file to a court, a port authority or the Guardia Costiera if they require it by law, for example after a casualty. If we are allowed to tell you, we will.

How long we keep files

  • Survey reports and working notes: ten years from the date of the report. That matches the ordinary limitation period for contract claims under Article 2946 of the Italian Civil Code, and a report is sometimes needed years later after a claim.
  • Invoices and accounting records: ten years, as Article 2220 of the Civil Code requires.
  • Enquiries that never became a survey: twelve months, then deleted.
  • Photographs not used in a report: deleted when the report is issued.

This website

The site is a set of static pages. It has no contact form, no login, no advertising and no analytics. We set no cookies.

The hull speed and passage fuel calculator runs entirely in your browser. The figures you type are never sent to us or stored anywhere.

Two things do happen when you load a page. Our hosting provider records standard server logs, including your IP address, the page asked for and your browser type. These are used to keep the site running and secure and are deleted within 30 days. And our typefaces are loaded from Google Fonts, so your browser connects to Google’s servers, which receive your IP address. Google acts as an independent controller for that connection. If you prefer, you can block third-party fonts in your browser and the site will still work.

Your rights

Under Articles 15 to 22 of the GDPR you can ask to see the data we hold about you, have it corrected, have it erased, restrict how we use it, take a copy in a usable format and object to processing based on our legitimate interest. Write to the survey desk and we will reply within one month.

Some limits are real. We cannot erase a client’s report because a seller named in it asks us to, as the client has a right to the report and we must keep it while claims are possible. We will explain if that applies to you.

You can complain to the Italian supervisory authority, the Garante per la protezione dei dati personali, Piazza Venezia 11, 00187 Roma, or to the authority in the EU country where you live. We would like the chance to put things right first.
